Fairview Terminal Phase II Expansion Project

March 11, 2008 (Updated May 2, 2012) -- The Prince Rupert Port Authority and Fisheries and Oceans Canada are required to ensure that a comprehensive study is conducted pursuant to the Canadian Environmental Assessment Act commencing on March 11, 2008 in relation to the project: Fairview Terminal Phase II Expansion Project. The Canadian Transportation Agency and Environment Canada are participating as they may also be required to conduct an environmental assessment of the project.

The Prince Rupert Port Authority, the Canadian Transportation Agency, Environment Canada and Fisheries and Oceans Canada are required to ensure that a comprehensive study is conducted pursuant to the Canadian Environmental Assessment Act commencing on March 11, 2008 in relation to the project: Fairview Terminal Phase II Expansion Project. The Prince Rupert Port Authority and the Canadian National Railway Company are proposing to expand its existing Fairview Container Terminal in Prince Rupert Harbour to increase the facility's current design capacity of 500,000 TEUs per annum (twenty foot equivalent) to 2,000,000 TEUs per annum. This will included extending the wharf structure and expanding the on-shore terminal components. T

his project will include: - site clearing, grubbing, grading, stripping, and cut and fill; - large volume rock cuts; - on-site construction of ten concrete caissons - construction of a pile and deck extension of the existing wharf; - dredging in front of the proposed caissons and for the containment berm and wharf structure; - construction of a rock berm and mattress; - in-filling (riparian, intertidal, and subtidal habitat) behind the containment berm (16 hectares); - installation of caissons and construction of the wharf topside; - eastern re-alignment of the existing CN Rail mainline across the proposed terminal; - container and intermodal yard facilities construction (14,000 m total linear track); - construction of two CN Rail sidings and an access road between the terminal and the southern end of Kaien Island (infilling of riparian and intertidal habitat, culvert extensions); and - construction of a CN Rail locomotive wye at the south end of Kaien Island (infilling of salt water lagoon habitat).

Under Section 5 of the Canadian Environmental Assessment Act, and environmental assessment is required in relation to this project because Fisheries and Oceans Canada, Environment Canada, and the Canadian Transportation Agency may issue permits or licenses under the Fisheries Act (Subsection 35 (2)), the Canadian Environmental Protection Act (Subsection 127(1)), and the Canada Transportation Act (Subsections 98(2) and 98(3), respectively. In addition to the Canadian Environmental Assessment Act, the Prince Rupert Port Authority is required to assess, for any proposed project located within the ports and lands under its control, the environmental effects of the project pursuant to the Canada Port Authority Environmental Assessment Regulations. This responsibility is reaffirmed in Subsection 9(1) of the Canadian Environmental Assessment Act. The Canadian Environmental Assessment Agency will act as the Federal Environmental Assessment Coordinator for this environmental assessment.

An environmental assessment is required in relation to the project because the Prince Rupert Port Authority is the proponent for the project and Fisheries and Oceans Canada may take action in relation to subsection 35(2) of the Fisheries Act.

The Canadian Environmental Assessment Agency will act as the Federal Environmental Assessment Coordinator for this environmental assessment.
