Notice determination
December 12, 2022 – Indigenous Services Canada has determined that the proposed Netmizaaggamig Nishnaabeg-Subdivision Development (Ontario) is not likely to cause significant adverse environmental effects

The determination was based on a consideration of the following factors:
            - impacts on rights of Indigenous peoples;
            - indigenous knowledge;
            - community knowledge;
            - mitigation measures.

Implementation of mitigation measures is required for the project to address:

  • During site investigations some small and medium stick nests, as well and a few very small grass nests were discovered in trees throughout the proposed development areas. No birds were seen in these nests during field investigations (May 2021). Stripping and clearing activities should be completed outside of the bird breeding season (April 21 to August 31) to ensure protection of the various bird species listed that could utilize the existing habitat for nesting. Most site clearing has already occurred.
  •  With respect to SAR in northern Ontario such as woodland caribou, wolverine, American badger, little brown bat and northern long-haired bat – no issues or concerns are expected given that no evidence of the species occurring at the sites was noted, the habitat within the subdivision is not specialized or suitable for these species.
  •  No fish will be impacted during construction activities.
  • We collected highly valuable information from our 2021 Elder's Field Trip project; some point data and rich oral history was obtained. These features help create and support Territorial and Communal Land Use Plans and development.
  • Ongoing maintenance to reduce potential impacts due to dust until surface treatment is completed. This will include periodic suppression operations.
  • Culvert Installation and Ditching – General conformance with sec. 5.7 of the MNR Environmental Guidelines for Access Roads and Water Crossings. Temporary Erosion control measures and Permanent Erosion control measures implemented at select locations.
  • Species at Risk – Inspection of the site prior to constructions operations.
  • Contaminated Soils – If contaminated soils are encountered, work shall stop until the source and extent of contaminants is determined. Remediation shall be under the direction of a qualified person in accordance with CCME.

Indigenous Services Canada is satisfied that that the carrying out of the project is not likely to
cause significant adverse environmental effects.

Therefore, Indigenous Services Canada may carry out the project, exercise any power, preform any duty or function, or provide any assistance to enable the project to be carried out in whole or in part.
